Gov’t tightens control over business conditions

VGP – PM Nguyen Tan Dung has signed a decision to establish a working group with an aim to put an end to uncontrolled promulgation of business conditions.

The working group will be led by Minister of Planning and Investment who is accompanied by Chairman of the Viet Nam Chamber of Commerce and Industry, Deputy Minister of Planning and Investment Dang Huy Dong, Vice Chairman of the Office of Government Kieu Dinh Thu, and Deputy Minister of Justice Dinh Trung Tung.

The working group is responsible for monitoring and supervising the implementation of regulations on business lines subjected to business conditions, coordinating with the Ministry of Planning and Investment, the Ministry of Justice and the Government Office in reviewing related legal documents adopted by ministries, agencies and localities prior to July 1, 2015 and proposing measures to address outdated regulations.

According to a report, there are 267 conditional business lines specified in the Investment Law. However, Mr. Nguyen Dinh Cung, Chairman of the Central Institute for Economic Management said a string of business conditions have been issued by ministries, agencies and localities.

Mr. Cung stressed that the Investment Law amended in 2014 says that business and investment conditions shall only be stipulated in laws, ordinances, decrees and international treaties. This means that only the National Assembly, the National Assembly Standing Committee, and the Government have the right to promulgate business conditions.

The working group must also conduct regular reviews to access the effectiveness of regulations on business conditions for appropriate amendments or abrogation./.
